1. Introduction

These Terms of Use ("Terms") govern your access to and use of the Easy PV website and related services (the "Platform"), operated by Midsummer Energy Ltd ("we," "us," or "our"). The Platform provides consumers in the United Kingdom with information, comparison tools, and referral services relating to residential solar panel installers (the "Services").

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Platform. By using the Platform, you confirm that you meet these requirements.

3. Nature of the Services

The Platform is an informational comparison and referral service only. We do not:

  • Install, sell, or maintain solar panels or related equipment;
  • Act as a party to any contract between you and a solar installer;
  • Guarantee pricing, savings, performance, availability, or suitability of any installer or solar solution.

Any agreement you enter into with a solar installer is solely between you and that installer.

4. No Advice

Information provided on the Platform does not constitute financial, legal, technical, or energy advice. You are responsible for carrying out your own checks and obtaining independent professional advice before engaging an installer.

5. Commercial Relationships

We may receive fees or other compensation from solar installers for referrals, leads, advertising, or enhanced listings. Such compensation may influence how installers appear on the Platform.

6. Third-Party Websites and Installers

The Platform may link to third-party websites or services. We are not responsible for the content, terms, or practices of third parties. Your dealings with installers are entirely at your own risk.

7. Intellectual Property

All intellectual property rights in the Platform and its content belong to or are licensed to us. You may not copy, reproduce, or exploit any part of the Platform without our prior written consent.

8. Prohibited Use

You must not:

  • Use the Platform unlawfully or fraudulently;
  • Attempt to gain unauthorised access to the Platform;
  • Scrape, harvest, or misuse data from the Platform;
  • Misrepresent your identity or submit false information.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties, representations, and conditions that may otherwise be implied.

10. Limitation of Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.

Subject to the above, we shall not be liable for any indirect or consequential losses, loss of profits, loss of data, or loss of business arising out of or in connection with your use of the Platform.

11. Indemnity

You agree to indemnify us against any losses or claims arising from your misuse of the Platform or breach of these Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

Privacy Policy

1. Introduction

This Privacy Policy explains how Midsummer Energy Ltd ("we," "us," or "our") collects, uses, and protects personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We are the data controller for personal data processed through the Platform.

2. Personal Data We Collect

2.1 Data You Provide

  • Name, email address, and telephone number;
  • Property and energy-usage information relevant to solar installation enquiries;
  • Reviews, feedback, and correspondence.

2.2 Automatically Collected Data

  • IP address and device identifiers;
  • Browser type, operating system, and usage data;
  • Cookies and similar technologies (see Section 10).

2.3 Data from Third Parties

  • Feedback or status updates from installers you engage with;
  • Aggregate analytics data from our analytics providers.

3. Lawful Bases for Processing

We process personal data under the following lawful bases:

  • Consent: where you request quotes, agree to marketing, or accept analytics cookies;
  • Contract: to provide the Platform and related services;
  • Legitimate interests: to improve our services, prevent fraud, and analyse Platform usage (balanced against your rights);
  • Legal obligation: where required by law.

4. How We Use Personal Data

We use personal data to:

  • Provide comparison and referral services;
  • Share your enquiry details with selected solar installers you choose to contact;
  • Communicate with you about your requests;
  • Improve and analyse the Platform;
  • Send marketing communications where permitted.

5. Sharing Personal Data

We may share personal data with:

  • Solar installers you choose to be contacted by;
  • IT and hosting providers;
  • Analytics providers — we use Google Analytics 4 (Google LLC, DPF-certified) and Matomo (self-hosted) to understand how the Platform is used. Google Analytics 4 may process data in the USA under the EU–US Data Privacy Framework;
  • A buyer or successor in the event of a business sale or restructuring.

We do not sell personal data.

6. International Transfers

Where personal data is transferred outside the UK (for example, to Google for analytics), we ensure appropriate safeguards are in place, including adequacy regulations and the UK International Data Transfer Agreement (IDTA), or we rely on the recipient's certification under an equivalent data privacy framework.

7. Data Retention

We retain personal data only for as long as necessary for the purposes set out in this Privacy Policy or to meet legal requirements. Lead enquiry data is retained for up to 24 months.

8. Data Security

We implement appropriate technical and organisational measures to protect personal data, including encryption in transit (TLS), access controls, and routine security reviews. However, no system is completely secure.

9. Your Data Protection Rights

Under UK GDPR, you have the right to:

  • Access your personal data;
  • Rectify inaccurate data;
  • Request erasure of your data ("right to be forgotten");
  • Restrict or object to processing;
  • Data portability;
  • Withdraw consent at any time (where processing is based on consent).

10. Cookies

We use cookies and similar technologies as described below. A cookie consent banner is shown on your first visit — you can accept all, reject non-essential, or customise your preferences at any time.

Necessary cookies are always active and required for the Platform to function.

Even without analytics consent, Google Analytics 4 may send cookieless pings to Google's servers for aggregate conversion modelling under Google Consent Mode v2. No cookies are set and no personal data is stored for this purpose.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via the Platform. The effective date at the top of this page will reflect the date of the latest revision.
